LUPA REVIEWS
From 1996 to 2004, the Delaware Office of State Planning Coordination oversaw the LUPA review process called for in the Land Use Planning Act (LUPA) to gather and coordinate a single "state" response to proposed land use changes.
That process has been replaced by the Preliminary Land Use Service (PLUS) created in Chapter 92 of Title 29 of the Delaware Code by the adoption of Senate Bill 65 in 2003. Starting February 14, 2004, 29 Del. Code ' 9203 requires major land use changes to be reviewed by state agencies prior to submission to local governments. That review is what is known as the PLUS review.
So why were there LUPAs in 2004 after February 14? Land use change proposals submitted to local jurisdictions prior to February 14, 2004 are still subject to the requirements of the LUPA process. Because state agencies are required to meet their obligations to local governments under the old LUPA system, there was a slow stream of LUPA reviews during 2004 as local governments worked through those proposals submitted prior to that date.

LUPA Sites (GIS Data)
Starting with 1999 LUPA proposals, the Office of State Planning Coordination used GIS to map and analyze proposals under LUPA review. LUPA projects were mapped in relation to the Strategies for state policies and spending as well as other georeferenced data.
The links below are to ZIPPED GIS data sets containing polygon and point data showing the general area of sites of proposed land use changes. The polygons are not intended to be cartographically accurate or to conform directly to legal parcel descriptions. Metadata files for these data sets have been added to the zipped files below and are posted on the Delaware Metadata Explorer.
